1. Acceptance of Terms

By accessing, requesting, scheduling, or receiving services from Clearpoint Exterior Washing ("Company"), you ("Customer") agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Description of Services

The Company provides exterior window cleaning and related services ("Services"), subject to availability, weather conditions, site accessibility, and safety requirements.

No Guaranteed Results:

Customer acknowledges that cleaning services are designed to improve appearance only and do not guarantee removal of all contaminants, including but not limited to hard water stains, mineral deposits, oxidation, paint overspray, or permanent defects. Such conditions may require separate restoration services.

Unless expressly stated in writing, Services do not include screens, tracks, frames, or interior cleaning.

3. Estimates & Pricing

All quotes are non-binding estimates based on limited information. Final pricing may be adjusted upon on-site inspection to reflect actual conditions, including but not limited to size, accessibility, condition, and scope.

4. Payment Terms

Payment is due immediately upon completion unless otherwise agreed in writing.

The Company reserves the right to:

(a) charge late fees on overdue balances;

(b) suspend or refuse future Services for non-payment;

(c) pursue collection remedies permitted by law.

5. Cancellations & Scheduling

Customer agrees to provide at least 24 hours' notice for cancellations or rescheduling. The Company reserves the right to impose fees for late cancellations or missed appointments.

The Company may reschedule or cancel Services due to weather, safety concerns, or circumstances beyond its control.

6. Recurring Services Authorization

By enrolling in recurring services, Customer authorizes ongoing scheduling and acknowledges that service frequency, pricing, and scope may be modified with reasonable notice. Customer may cancel recurring services upon notice.

7. Access & Site Conditions

Customer represents that they have lawful authority to grant access to the property.

Customer agrees to:

  • Provide adequate access to the service area and water sources if required
  • Secure pets and remove hazards
  • Disclose any known risks or fragile conditions

Failure to meet these conditions may result in service refusal or rescheduling.

8. Assumption of Risk & Pre-Existing Conditions

Customer acknowledges that properties may contain pre-existing defects. The Company shall not be liable for damage resulting from such conditions, including but not limited to:

  • Scratched, cracked, or improperly installed glass
  • Failed window seals or fogging
  • Oxidized, brittle, or degraded materials
  • Loose or defective screens, frames, or fixtures

Customer further acknowledges that cleaning may reveal latent defects not previously visible.

9. Limitation of Liability

To the maximum extent permitted by law, the Company's total liability shall not exceed the amount paid for the specific Service giving rise to the claim.

In no event shall the Company be liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, revenue, or profits.

10. Disclaimer of Warranties

Services are provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied, including merchantability or fitness for a particular purpose.

11. Indemnification

Customer agrees to indemnify and hold harmless the Company from any claims, damages, or liabilities arising from:

(a) Customer's breach of these Terms;

(b) inaccurate or incomplete information provided;

(c) unsafe property conditions;

(d) violation of applicable laws or third-party rights.

12. Communications & Consent (TCPA Compliance)

By providing contact information, Customer expressly consents to receive communications via phone, email, and SMS, including automated messages.

  • Consent is not a condition of purchase

Customer may opt out at any time.

13. Privacy

Customer information is collected and used solely for service delivery, communication, and marketing purposes. The Company does not sell personal data.

14. Media Release

Customer grants the Company the right to capture and use photographs or videos of the property for marketing purposes, unless revoked in writing prior to service.

15. Independent Contractors

Services may be performed by employees or independent contractors retained by the Company.

16. Force Majeure

The Company shall not be liable for delays or failure to perform due to events beyond its reasonable control, including but not limited to weather, natural disasters, labor shortages, or utility interruptions.

17. Dispute Resolution

These Terms shall be governed by California law.

Any dispute shall be resolved exclusively through binding arbitration in Los Angeles County under the rules of the American Arbitration Association.

Each party shall bear its own legal fees unless otherwise awarded.

Customer waives any right to participate in class actions.

18. Modifications

The Company may modify these Terms at any time. Continued use constitutes acceptance.
